GENIE HANDS LLC — TERMS & CONDITIONS & LIABILITY WAIVER
Please read carefully before scheduling an appointment or receiving services.
1. Agreement to Terms
By scheduling an appointment or receiving services from Genie Hands LLC (“Company,” “we,” “us”), you (“Client”) acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions and Liability Waiver.
2. Nature of Services (Non-Medical Disclaimer)
All services provided by Genie Hands LLC are for wellness, relaxation, and post-recovery support only and are not medical treatment. Services are non-medical wellness offerings intended for relaxation, recovery support, and aesthetic purposes.
- Services are not a substitute for medical care and do not replace examination, diagnosis, or treatment by a licensed healthcare provider
- The practitioner does not diagnose, treat, or prescribe
- No medical claims or guarantees are made
Client acknowledges that any reliance on services is at their own risk. Where Manual Lymphatic Drainage (MLD) or related techniques are offered, Section 5 applies.
3. Assumption of Risk
Client understands that services (including but not limited to massage, post-operative bodywork, stretching, and body contouring) involve inherent risks, including but not limited to:
- soreness, bruising, or swelling
- aggravation of existing conditions
- unforeseen physical reactions
Client voluntarily assumes all risks, known or unknown, associated with participation.
4. Health Disclosure & Client Responsibility
Client agrees to:
- Provide accurate, complete, and truthful health information
- Disclose all medical conditions, surgeries, medications, and contraindications
Client agrees to immediately notify the practitioner of pain, discomfort, or adverse reactions.
Failure to disclose relevant information constitutes assumption of liability by the Client.
5. Client Safety & Care Agreement — Manual Lymphatic Drainage (MLD)
The following applies specifically to Manual Lymphatic Drainage (MLD) and related techniques offered by the Company. It mirrors the Client Safety & Care Agreement on the Company’s medical intake form.
- Client understands that Manual Lymphatic Drainage supports lymphatic flow, may help reduce swelling, and promotes relaxation.
- Client understands MLD is not a substitute for medical care and does not replace examination, diagnosis, or treatment by a licensed healthcare provider.
- Client understands that incisional drainage or work on open skin is not performed.
- Client understands services will not be provided if the Client has an active infection, untreated complication, or other condition that makes treatment unsafe, until the Client is cleared as appropriate.
- Client understands the Company may require written medical clearance when reasonably necessary for the Client’s safety (for example, after surgery or when records are unclear), in addition to what the Client reported on the Company’s intake forms.
6. Post-Surgical Client Acknowledgment
For post-operative services:
- Client confirms they have received medical clearance, where applicable
- Client acknowledges that services are supportive only, not medical treatment
- Client accepts all risks associated with post-surgical recovery
Client understands that failure to follow medical guidance may result in increased complications or termination of service without refund.
7. Appointments & Acceptance of Service
All appointments are subject to approval.
An appointment is not confirmed until all of the following have occurred:
- The appointment request is submitted
- The Terms are accepted
- The deposit is paid
- Client information is reviewed
The Company reserves the right to refuse or cancel any appointment, modify appointment timing, or decline service for safety or operational reasons.
8. Payment Terms
A non-refundable deposit of $100 is required to secure all appointments. The deposit is applied toward the total service cost. The remaining balance must be paid as required before or at the time of service.
Failure to complete payment may result in cancellation of the appointment or forfeiture of the deposit.
9. Cancellation, Rescheduling & No-Show Policy
- Changes must be made at least 24 hours in advance
- Changes within 24 hours may incur a $40 fee
- Same-day cancellations are non-refundable
- No-shows result in full forfeiture of deposit
10. Late Arrival Policy
Late arrival may result in reduced service time. Full service fee remains due.
11. Mobile Service & Location Liability
Client acknowledges that services are provided at a location chosen by the Client.
Client agrees that the location is safe, clean, and suitable for service. The Company is not responsible for environmental hazards, unsafe conditions, or third-party actions.
Client assumes responsibility for parking fees and access to the service location.
The Company reserves the right to refuse or terminate service if the environment is deemed unsafe.
12. Service Area & Travel Terms
Travel fees may apply outside designated service areas. Service may be refused based on location, traffic conditions, or accessibility.
We do not service:
- Beach areas
- Downtown Miami
- Brickell
13. Right to Refuse or Terminate Service
The Company reserves the absolute right to refuse service at any time or terminate a session immediately. Reasons include, but are not limited to: safety concerns, undisclosed medical conditions, active infection or other conditions described in Section 5 where applicable, or inappropriate behavior.
If service is refused or terminated under these conditions, no refund will be issued.
14. Client Conduct & Zero Tolerance Policy
Client agrees to maintain appropriate conduct. Any of the following will result in immediate termination: inappropriate behavior, harassment, or unsafe or threatening conduct.
Client forfeits all payments and may be permanently refused service.
15. Limitation of Liability
To the fullest extent permitted by Florida law, Genie Hands LLC shall not be liable for injuries, complications, damages, or losses arising from or related to services provided, except in cases of gross negligence or willful misconduct.
16. Indemnification
Client agrees to indemnify, defend, and hold harmless Genie Hands LLC from any claims, damages, liabilities, or expenses arising from Client’s failure to disclose medical conditions, Client negligence, misuse of services, or violation of these Terms.
17. No Guarantee of Results
Client acknowledges that results vary by individual, that no outcomes are guaranteed, and that multiple sessions may be required.
18. Privacy & Use of Information
Client information is used solely for service delivery, scheduling, and communication. Information is kept confidential unless required by law.
19. Governing Law
These Terms shall be governed by the laws of the State of Florida.
20. Severability
If any provision is found unenforceable, the remaining provisions remain in full force.
21. Entire Agreement
These Terms constitute the entire agreement between the Client and Genie Hands LLC.
22. Acknowledgment & Electronic Consent
By scheduling an appointment, signing, or checking any acknowledgment box, the Client confirms that they have read and understood these Terms; that they agree to be legally bound by them; and that they waive certain legal rights, including the right to sue, to the extent permitted by law.
